Below is the text exactly as we store it: every word, space and line break, unedited. It is shown in the language it was published in.

1. What This Agreement Covers

These Free Website Campaign Terms & Conditions (the "Terms") form a binding agreement between A&S AI Solutions LLC d/b/a Olynx, a Delaware limited liability company ("Olynx," "we," "us," or "our"), and the business that submits the intake form at olynxai.com/freewebsite ("you," "your," or "Client").

By checking the acceptance box on the intake form, you agree to these Terms. If you do not agree, do not submit the form.

You are accepting on behalf of a business. You represent that you are at least eighteen (18) years old and that you are authorized to bind that business to this agreement.

2. Relationship to the Olynx Terms of Service

This is a standalone promotional offer. It does not require an Olynx account, a subscription, a credit card, or any payment during the free period described in Section 6.

The "Included Website" described in Section 7 of the Olynx Terms of Service is a different service: it is bundled with a paid Subscription and carries its own buy-out terms. Nothing in this document changes that service, and nothing in Section 7 of the Olynx Terms of Service applies to a website delivered under this campaign.

Where these Terms conflict with the general Olynx Terms of Service as to a website delivered under this campaign, these Terms control. Our Privacy Policy applies to both and is incorporated here by reference.

3. Eligibility — United States Only

This offer is available only to businesses located in and operating from the United States, and only to individuals accepting from within the United States. It is not offered to, and may not be accepted by, residents or businesses of the European Economic Area, the United Kingdom, Switzerland, Canada, or any other jurisdiction outside the United States.

We may verify eligibility and may decline or withdraw any submission that does not meet it.

If you submit information from outside the United States, you do so on your own initiative and against these Terms, and you consent to your information being processed in the United States.

4. The Offer, and Why It Is Limited

We are building free websites for the first one hundred (100) qualifying businesses that complete the intake form. The live counter on the campaign page reflects reserved spots.

Submitting the form reserves a numbered spot. It does not, by itself, guarantee that a website will be produced. We may decline a submission, in our sole discretion, including where the submission is incomplete, appears fraudulent or automated, duplicates an existing submission, concerns a business or content described in Section 11, or where we are unable to reach you.

If we decline your submission, your spot is returned to the pool and we will tell you at the email address you provided. You owe us nothing and we owe you nothing further.

One website per business. Submitting under multiple email addresses to obtain more than one free website is a breach of these Terms.

5. What We Collect From You, and Why

The intake form asks you to provide, and you choose to provide, the following. Each item exists because it is used to design, write, or publish your website.

Business and contact information: your name; your business or brand name; your industry or niche; a public contact phone number; a public contact email address; the services you offer and your descriptions of them; a description of your business; your business hours for each day of the week.

Operating information: your market focus; the geographic areas you serve; your physical business address, if you provide one; whether you are licensed and insured, offer free estimates, or offer 24/7 emergency service; your years of experience; the warranties you offer; why customers should choose you; the payment methods you accept; your brand voice; and your target audience.

Web presence: whether you own a domain and, if so, its name; and links to your social media profiles.

Website structure: the actions you want visitors to take; the pages you want; where new leads should be sent, including a lead email address, a booking link, or a WhatsApp number if you provide them; frequently asked questions and their answers; and testimonials.

Brand and imagery: your logo; a cover photo; between eight and fifteen job photographs and any captions you write for them; your brand colors, including custom color codes; a heading font; style preferences; animation preferences; and any additional notes you write.

Collected automatically when you submit: your IP address, your browser's user-agent string, the page that referred you, your language preference, and the date and time of submission. We collect these to prevent fraud and abuse of a limited free offer, to enforce our rate limits, and to keep a record of your acceptance of these Terms.

Note on public information. The phone number, email address, physical address, hours, services, and social links you provide are intended for publication on your website. Do not enter a personal phone number, home address, or email address that you do not want to appear publicly. Once your site is published, that information is public.

We do not knowingly collect Social Security numbers, financial account numbers, government identification numbers, health information, precise geolocation, biometric data, or information about children under sixteen (16). Do not submit them. If you do, we may delete them without notice.

6. Free for Three Years

Your website is free for three (3) years. The three-year period begins on the date we first publish your website and make it reachable at a live address, not on the date you submit the form.

During that period there is no charge for the build, the design, the copywriting, hosting, or SSL. We will not ask you for a credit card and we will not charge you.

The free period covers the website as delivered. It does not include ongoing redesigns, new pages, e-commerce, custom application development, paid advertising, content writing beyond the initial build, third-party software fees, or your domain (see Section 8). We may offer those separately; you are never required to buy them, and declining them does not affect your free three years.

6b. The Olynx Subscription Is Optional and Separate

Your website comes with a contact form. On the intake form you choose where those messages go: to your email address, at no cost, or into the Olynx app.

Sending them to the Olynx app requires an Olynx subscription, which is a separate paid product and is NOT part of this free offer. It is Three Hundred Forty-Nine U.S. Dollars (US $349.00) per month, plus applicable tax, or a one-time payment of Two Thousand U.S. Dollars (US $2,000.00) for lifetime access. The lifetime price is a promotion and may be withdrawn or changed for new customers at any time; it does not change for anyone who has already bought it.

Nothing is sold on the intake form. Choosing "Olynx" records your interest and nothing else: no card is taken, no charge is made, no price is agreed, and no account is created. We will contact you to explain the product, and you are free to say no. Any purchase happens later, separately, and is governed by the Olynx Terms of Service rather than this document.

Buying the Olynx subscription is never a condition of receiving your free website. If you decline it, or ignore it, your website is built and delivered exactly the same, under exactly these Terms. Anyone who tells you otherwise is wrong.

If you do subscribe, that subscription is governed by the Olynx Terms of Service, not by this document.

7. What Happens After Three Years

After the three-year free period, continued hosting and maintenance of your website by Olynx costs sixty U.S. dollars (US $60.00) per year, plus any applicable tax.

We will not charge you automatically. There is no auto-renewal, no card on file, and no subscription that starts on its own. At least thirty (30) days before your free period ends, we will email the address on file with the renewal offer and the date your free period ends. Continuing is your choice and requires an affirmative act by you.

If you choose to continue, you pay sixty U.S. dollars for the following twelve (12) months. We will give you at least thirty (30) days' written notice by email before any change to that price takes effect, and you may decline and take the handover described below instead.

If you do not respond, or you decline, we will not bill you. Your website is handed over to you under Section 8, and Olynx's hosting of it ends.

8. Handover — You Keep Everything

If you decline to continue after the free period, or you ask us to stop at any time, we hand your website over to you. We keep nothing.

Within thirty (30) days of the end of your free period, or of your written request, we will provide you with an export containing the files that make up your website, the text and copy written for it, and the images you supplied. You may host it wherever you like, and you may hire anyone you like — another developer, an agency, or your nephew — to maintain it. You do not need our permission and you do not owe us a fee to do so.

We claim no ownership of your business name, your logo, your photographs, your content, or your website. We assert no lien over them and we will not hold them hostage against payment.

After handover, Olynx stops hosting the site. Any address we were hosting it at stops working. If your site is running on a domain you own (Section 9), you point that domain at your new host and your visitors notice nothing.

We keep a copy of your submission and of the site we built for our own records and for the period described in Section 12. That is a record, not a claim of ownership.

9. Your Domain Is Yours to Buy and to Pay For

A domain name — for example, yourcompany.com — is separate from your website and is not part of this offer.

You are responsible for purchasing your own domain, in your own name, from the registrar of your choice, and for paying to renew it every year for as long as you want your website reachable at that address. A domain typically costs between ten and fifteen U.S. dollars per year. We may point you to registrars and explain how to buy one; we are not a party to that purchase and we earn nothing from it.

Register the domain in your business's name, with your own account and your own payment method. We do not want to hold your domain and we recommend that no vendor, including us, holds it for you.

If your domain expires, is suspended, is transferred away, or is cancelled, your website stops being reachable at that address. That is outside our control. We are not responsible for a lapsed domain, for a registrar's actions, for domain renewal prices, or for a domain someone else registers after yours expires.

A domain is required to receive your free website. You may submit the intake form before you have one, and we will begin design work and hold your reserved spot. Your website goes live once you own a domain and send us the name. Until then there is nothing for us to publish it on.

While your site is being built we may preview it at a temporary address we control. That address is for review only, is not a permanent home, and stops working after handover under Section 8.

If you never obtain a domain, we may release your reserved spot back to the pool after giving you at least thirty (30) days' notice by email. You owe us nothing, and you may apply again if spots remain.

10. The Content You Give Us

You keep ownership of everything you send us: your logo, your photographs, your text, your trademarks, and your business information.

You grant us a limited, non-exclusive, royalty-free license to use, reproduce, adapt, resize, re-encode, and publish that material for the sole purpose of designing, building, publishing, hosting, and supporting your website under this campaign. This license lasts as long as we host your site and ends on handover, except for the archival copy described in Section 12.

You represent and warrant that, for everything you submit:
(a) you own it, or you have written permission to use it and to let us use it as described above;
(b) it does not infringe anyone's copyright, trademark, or other rights;
(c) any identifiable person appearing in a photograph has given you permission to use their likeness commercially, and if a photograph shows the inside of a customer's home or property, you have that customer's permission;
(d) it is accurate and not misleading; and
(e) it does not contain anyone else's confidential information.

You will indemnify and hold Olynx harmless against any third-party claim, and against the resulting damages, liabilities, costs, and reasonable attorneys' fees, arising out of a breach of this Section. This is the practical consequence of a photo pulled from a Google search: the claim lands on you, not on us.

We may remove any material we reasonably believe breaches this Section, and we will tell you when we do.

11. Testimonials, Claims, and Content Standards

Testimonials must be real. If you provide testimonials or reviews, you represent that each one reflects the genuine, typical experience of an actual customer, that you have that customer's permission to publish it, and that you have not offered anything of value in exchange for it without disclosing that fact. Fabricated, purchased, or materially altered testimonials are prohibited. This mirrors the Federal Trade Commission's rules on consumer reviews and testimonials, including 16 C.F.R. Part 465 and the Endorsement Guides at 16 C.F.R. Part 255. You are the advertiser, and you bear the FTC exposure for claims made on your site.

Claims must be substantiated. Statements you ask us to publish — that you are licensed, insured, bonded, certified, "#1," "award-winning," "guaranteed," or that you have been in business for a stated number of years — must be true and you must be able to prove them. We publish what you tell us; we do not verify it, and we are not responsible for verifying it.

Licensing and regulated trades. Many trades require state or local licensure, and many states regulate how a license number must be displayed in advertising. Confirming that your website satisfies the advertising rules of your trade and your state is your responsibility.

Prohibited content. We will not build or host a site that promotes: illegal goods or services; firearms, explosives, or regulated weapons; illegal drugs or drug paraphernalia; sexually explicit material; gambling; multi-level marketing or pyramid schemes; payday or predatory lending; counterfeit goods; deceptive health, income, or investment claims; harassment or hatred toward any group; or any content that violates the law. We decide this in our sole discretion, and declining a submission on these grounds costs you nothing.

12. Privacy and Your Rights Under US State Law

How we use what you give us. We use your information to build, publish, host, and support your website; to contact you about it; to prevent abuse of a limited free offer; and to keep a record of your acceptance of these Terms. We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act as amended by the CPRA.

Who else sees it. We use service providers to operate the campaign — hosting, database and file storage, email delivery, and the artificial-intelligence services used to draft website copy. They are bound to use your information only to provide those services to us. We may also disclose information where required by law, to enforce these Terms, or in connection with a merger or sale of our business, in which case we will say so.

How long we keep it. We keep your submission for as long as we host your website and for three (3) years after handover or after a declined submission, to defend against claims and to evidence your acceptance of these Terms. You may ask us to delete it sooner.

Your rights. Depending on the state you live in — including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others as their laws take effect — you may have the right to know what personal information we hold about you, to obtain a copy of it, to correct it, to delete it, to opt out of sale or targeted advertising (we do neither), and to not be discriminated against for exercising those rights. To exercise any of these, email olynxaiapp@gmail.com from the address you submitted, and we will respond within the time your state's law allows. If we deny a request, you may appeal by replying to our response.

Nevada residents may direct us not to sell covered information; we do not sell it in any event.

Email and text messages. We will contact you about your website at the email address you provide. The phone number you give us is published on your website and may be used to call you, manually, about your request. We will text you, or call you using automated technology or an AI voice assistant, only if you tick the separate, optional box for calls and texts on the form. That consent is not a condition of receiving the free website, and you can withdraw it at any time. Message frequency varies; message and data rates may apply; reply STOP to opt out of texts and HELP for help. Our commercial email includes an unsubscribe mechanism and complies with the CAN-SPAM Act.

13. No Warranty, and the Limits of What We Owe You

The website is provided free of charge, "AS IS" and "AS AVAILABLE," without warranty of any kind. To the fullest extent permitted by law, Olynx disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not promise that your website will rank in search engines, appear on any particular page of results, generate traffic, generate leads, generate revenue, or produce any business outcome. Anyone who promises you that is not being straight with you.

We do not promise uninterrupted or error-free hosting. We do not promise that your website will satisfy the Americans with Disabilities Act, the Web Content Accessibility Guidelines, or any accessibility standard, or that it will comply with the advertising or licensing rules of your trade or state. We build in good faith; the legal compliance of your published content is yours.

To the fullest extent permitted by law, Olynx's total aggregate liability arising out of or relating to this campaign, whether in contract, tort, or otherwise, shall not exceed one hundred U.S. dollars (US $100.00). Olynx shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, or loss of goodwill, even if advised of the possibility.

Some states do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing here limits liability for fraud, willful misconduct, or gross negligence.

You are receiving a website at no cost. These limits are the consideration that makes a free offer possible.

14. Disputes, Governing Law, and Notices

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and by applicable United States federal law.

Talk to us first. Before filing anything, email olynxaiapp@gmail.com with a description of the dispute and what you want. We will try in good faith to resolve it within thirty (30) days. Most problems end here.

If we cannot resolve it, the dispute shall be brought exclusively in the state or federal courts located in Delaware, and you and Olynx each consent to the personal jurisdiction of those courts. Nothing in this Section prevents either party from seeking injunctive relief, or from bringing an individual claim in small-claims court.

Your rights under your own state's consumer-protection statutes are not waived by this Section, and nothing here is intended to waive any right that cannot lawfully be waived.

Notices to you are given by email to the address you submitted. Notices to us go to olynxaiapp@gmail.com.

15. Changes, Ending, and the Rest

Changes to these Terms. We may update these Terms. If a change is material and you have an active website with us, we will email you at least thirty (30) days before it takes effect, and you may decline by taking the handover in Section 8. The version and date of the Terms you accepted are recorded with your submission.

Ending it. You may stop at any time by emailing us; we will hand over your website under Section 8. We may end this campaign, or our hosting of a particular site, for breach of these Terms, for the content reasons in Section 11, or if we discontinue the campaign — in which case we will give you the handover in Section 8 rather than leave you without a website.

Independent parties. This agreement does not create a partnership, joint venture, employment, or agency relationship. You are not our employee and we are not your employee.

Transfer. You may not transfer this agreement without our written consent. We may transfer it in connection with a merger, acquisition, or sale of assets.

If a clause fails. If any provision is held unenforceable, it is modified to the minimum extent necessary to make it enforceable, or severed, and the rest stays in force.

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and Olynx regarding this campaign, and supersede any prior statement, advertisement, or conversation about it. A failure to enforce a provision is not a waiver of it.

Contact. There is one address for everything: olynxaiapp@gmail.com. Use it for questions about your website, for privacy requests under Section 12, and for legal notices under Section 14.
